1.   What is covered by the policy?

The Insurer will compensate you for the amount of any AWARD made against you by the CCMA, Bargaining Council or Private Arbitration Centre, for the DISMISSAL of an employee within the limits of the policy.

 

2.   How do I calculate premium?

Be so kind to see the premium calculation document.  We calculate the premium on the amount of Employers in your group policy and NOT the amount of employees.  Here is an example:

If you wish to insure 10 employers for R75 000.00 cover per annum per employer the calculation is the following:

10 x R195.00 = R1 950.00 per month.

If you wish to insure 5 employers for R150 000.00 cover per annum per employer the calculation is the following:

5 x R450.00 = R2 250.00 per month.

If you wish to insure 5 employers for R250 000.00 cover per annum per employer the calculation is the following:

5x R550.00 = R2 750.00 per month.

So, the total premium payable is R1 950.00 + R2 250.00 + R2 750.00 = R6 950.00 per month.

3.   Do I pay monthly or annual premium?

You have two options, you can either pay on a monthly or annual basis. 

In our experience group policy holders pay on a monthly basis, since you may add or cancel clients during the year.

4.   When can I pay my premium?

We collect the premium by debit order.  You have the option to pay the premium on the

1st, 7th or 15th of the month.

 

5.   How is premiums paid?

We collect premium by way of debit order.

 

6.   What must be done if a premium is not paid?

You only have a 15 day grace period to rectify the missed premium.  If the payment is outstanding after this period, the policy is cancelled.

A electronic payment of the premium must be made to us.

7.   Can my client do their own disciplinary hearings?

No.  You as the representative must chair the disciplinary hearing, or you as the representative may represent the employer at the hearing and a third party must act as the chairman of the hearing.

 

8.   May the employer dismiss the employee without our consent?

No.  When the disciplinary hearing is concluded, the labour representative must send the recommendation so that we can determine if we agree with dismissal.  This must be done before the recommendation is delivered to the employee.

The normal process is that the recommendation is sent via email to, labourline@mooirivierclrs.co.za and urgent recommendations can be discussed telephonically at, 087 170 0189 – option 3.

 

9.   Can my client represent themselves at the CCMA, Bargaining Council, or Private Arbitration?

No.  You as the representative must represent the employer at the forum.  You as the representative must at all times have the ability to appear at these proceedings. 

 

10.  Must the employer be part of an employers Organisation?

Yes.  It is not possible for the employer to be represented at the different forums without being a member of an Employers Organisation.  It is a condition of the policy that the employer must be represented by an authorised representative.

 

11.  Who are authorised representatives?

The labour representative who instructed us to issue a policy, is authorised by us, during the policy application process.  It is a condition of the policy that the representative must be able to represent the employer at the different forums, since the employer is not allowed to represent itself at these forums.

 

12.  What must I do when my client goes to the CCMA?

  • You do not have to send us the referral form.

  • You must represent the employer at the CCMA.

  • You may not settle the matter without our written consent.

  • The arbitration award must be sent to us, within 7 business days, if the award is made in favour of the employee.

 

13.  What is our office hours?

Disciplinary hearings:                                                                     Mondays to Fridays: 08:00 to 16:30

14.  How must a claim be lodged?

  • Send the Arbitration Award or approved settlement to admin@mooirivierclrs.co.za

  • Our claims department will forward to you the claim form.

  • You must forward to our claims department all the applicable documentation as requested.

 

15.  When will the claim be paid?

  • As soon as all the relevant documentation has been received the matter will be put to the Insurer for approval.

  • If the claim is approved, you must complete the agreement of loss.

  • After the agreement has been received, payment will be effected within 3 business days.

 

16.  How will the claim be paid?

Payment is made into the bank account of the employer.

 

17.  How do I cancel my policy?

Written cancellation of the policy must reach us before the 25th of the month to ensure that the premium will not be deducted the next month.

 

This policy is paid in advance.
